When using Smotch.com, the user and RLE shall be subject to any posted rules or guidelines applicable to such services provided only by Smotch.com. Such rules and guidelines may be changed without notification. All current rules and guidelines will be posted and are able to viewed at http://www.smotch.com/.
Smotch.com provides users with a web-based tool for the creation and management of office pools, including but not limited to, professional baseball, football and golf, college football and auto racing. RLE reserves the right to amend any of its supported events.
The use of Smotch.com is intended for entertainment purposes only. RLE does not endorse nor support any type of illegal gambling. RLE also reserves the right to terminate any membership it believes to be conducting such activity without warning and without liability to Smotch.com or RLE.
All pools on smotch.com are considered owned by the Private Pool Administrator. The Private Pool Administrator is solely responsible for the management of any pool. Management of pools includes, but is not limited to, information entry and the timely updating of such information.
Should the pool award a prize, it is the sole responsibility of the Private Pool Administrator to award such prizes. RLE bears no responsibility or liability for any errors, omissions, negligence or wrongful acts by the Private Pool Administrator in the management of the pool, or pools, in the awarding of any prize or for other damages, direct or consequential, resulting from the participation of any Private Pool.
RLE only retains user information on file for the sole purpose of facilitating communication between RLE, Smotch.com, the Private Pool Administrator and its pool players.
RLE will not sell, distribute or license our membership list to any other website or business, public or private, without your expressed consent.
Please note that by registering on Smotch.com and by using its service(s), you consent to periodic communications from RLE and Smotch.com about new services or features offered by RLE and Smotch.com.
If you are not satisfied with the services offered on Smotch.com for any reason, you may request a refund with in 15 days of purchase. Your money will be refunded in the same method of the original payment and your pool will be deleted. Notification of deletion to pool players is the sole responsibility of the Private Pool Administrator.
You are responsible for maintaining the confidentiality of your username and password as well as all activities occurring under the username. You agree to ensure the log off from your account after each session. RLE and Smotch.com cannot and will not be held liable for any loss or damage arising from failure to comply with this Section.
The user and RLE agree to submit to the personal and exclusive jurisdiction of the courts located with in the State of Illinois.
IN NO EVENT SHALL REBEL LION ENTERPRISES, LLC, ITS SUBSIDIARIES, EMPLOYEES OR SUPPLIERS BE LIABLE FOR LOST INCOME OR PROFITS OR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CNNECTION WITH THIS WEBSITE, ITS SERVICES OR THIS AGREEMENT (HOWEVER ARISIING, INCLUDING NEGLIGENCE).
REBEL LION ENTERPRISES, LLC’S LIABILITY, AND THE LIABILITY OF ITS SUBSIDIARIESM EMPLOYEES AND SUPPLIERS, TO YOU OR ANY THIRD PARTIES IN ANY CIRCUMSTANCE IS LIMITED TO THE GREATER OF (A) THE AMOUNT OF FEES YOU PAY TO US IN THE SIX (6) MONTHS PRIOR TO THE ACTION GIVING RISE TO THE LIABILITY AND (B) $20.00.
